A BILL to amend and reenact section fourteen, article
nine, chapter sixty-four of the code of West
Virginia, one thousand nine hundred thirty-one, as
amended, relating to authorizing the board of
examiners of psychologists to promulgate a legislative rule relating to fees.
Be it enacted by the Legislature of West Virginia:
That section fourteen, article nine, chapter
sixty-four of the code of West Virginia, one thousand
nine hundred thirty-one, as amended, be amended and
reenacted, to read as follows:
ARTICLE 9. AUTHORIZATION FOR MISCELLANEOUS AGENCIES AND
BOARDS TO PROMULGATE LEGISLATIVE RULES.
§64-9-14. Board of examiners of psychologists.
(a) The legislative rule filed in the state register
on the thirtieth day of August, one thousand nine hundred
ninety-six, under the authority of section six, article
twenty-one, chapter thirty of this code, modified by the
board of examiners of psychologists to meet the
objections of the legislative rule-making review
committee and refiled in the state register on the
twenty-eighth day of February, one thousand nine hundred
ninety-seven, relating to the board of examiners of
psychologists (qualifications for licensure as a
psychologist or school psychologist, 17 CSR 3), is
authorized.
(b) The legislative rule filed in the state register on the thirtieth twenty-fifth day of August July, one
thousand nine hundred ninety-six ninety-seven, authorized
under the authority of section six, article twenty-one,
chapter thirty of this code, modified by the board of
examiners of psychologists to meet the objections of the
legislative rule-making review committee and refiled in
the state register on the twenty-third day of January,
one thousand nine hundred ninety-eight, relating to the
board of examiners of psychologists (fees, 17 CSR 1), is
disapproved, and not authorized for promulgation
authorized with the amendments set forth below:
On page one, subsection 2.3 by striking out the
words "Two hundred and fifty dollars ($250)" and
inserting in lieu thereof "One hundred and seventy-five
dollars ($175)";
And,
On page one, subsection 2.7 by striking out the
words "Two hundred and fifty dollars ($250)" and
inserting in lieu thereof "One hundred and seventy-five
dollars ($175)"
NOTE: The purpose of this bill is to authorize the
Board of Examiners of Psychologists to promulgate a legislative rule relating to fees.
Strike-throughs indicate language that would be
stricken from the present law, and underscoring indicates
new language that would be added.
